APDA Membership Agreement and Application
1. Purpose of the Association
The purpose of the Apple Programmer's and Developer's Association
("the association") is to promote the development of products that
are compatible with Apple computers. Apple has authorized the
distribution through the association of several technical documents
and Apple software products (such as tools, utilities, and languages)
that will be useful to developers of Apple-compatible products. These
products are not available through Apple dealers. In addition, the
association distributes Apple-compatible software products and solutions
from third-party vendors. Thus, the association provides a one-stop
service for programmers and developers working with Apple hardware.
2. Benefits of Membership
Membership in the association gives members the right to acquire
Apple-compatible products and information services through the
association. In addition, members will receive a quarterly
newsletter containing notices of the availability of new products,
detailed product descriptions, and a price list.
AGREEMENT
By signing the Apple Programmer's and Developer's Association
application, the applicant hereby applies for membership in the
association and, if accepted by the association as a member, agrees
to the following terms of membership:
1. Membership Fee
Upon paying a yearly membership fee of $20 (in the U.S.; $25 in Canada
or Mexico, $35 in other countries), applicant will have the
right for one year to acquire products and other services from
the association at regularly published prices (less any applicable
discounts), and to receive the quarterly newsletter.
2. Terms and Conditions for Apple Computer Products
a. Software products will be subject to a license agreement. Applicant
acknowledges and agrees that all Apple Computer software products
available through the association will be licensed NOT SOLD to the
applicant, and that those software products will be shipped to the
applicant with a license agreement attached to the product. Applicant
may obtain copies of the license agreement in advance from the
association, if desired. Applicant agrees that by using the product,
applicant will be bound by the terms of the license. If applicant
does not agree to the license terms, applicant may return the
unopened product to the association within three days of receipt,
and receive a full refund.
b. Applicant's acknowledgment of the nature of the products distributed
by the association. Applicant represents to the association that
applicant is a software or hardware developer, and has substantial
experience in computer programming and in using programmers' tools
and utilities in the development of software. Applicant understands
and acknowledges that the products distributed through the association
are of a highly technical nature, and that neither the association,
nor Apple Computer, Inc., nor authorized Apple dealers will offer the
applicant technical support in the use of such products.
Applicant further acknowledges and understands that many of the
products may contain errors, and that the documentation for the
products may be nonexistent, incomplete (working documents only),
or inaccurate.
Applicant understands that most or all of these products will be
licensed or sold without warranty of any kind whatsoever, and that,
pursuant to the license agreements under which the products are
licensed, neither the association nor Apple Computer, Inc. will
be responsible for any lost profits, lost data, or any other kind
of direct or indirect damage that may result from the use of the
products.
c. No right to distribute.
Applicant acknowledges that under the license agreements,
applicant will have no right to further distribute products
produced by Apple Computer, Inc. and acquired through the
association. Licenses for further distribution may be obtained
from the Apple Computer Licensing Department, Mail Stop 28-B,
20525 Mariani Avenue, Cupertino, California 95014.
3. Policies and Conditions for Third-Party Products
Software and other products from third-party producers range from
full commercial versions to preliminary releases. License agreements,
warranties, commercial distribution policies, and other conditions vary.
